Milwaukee Chapter 13 Bankruptcy Lawyer
Chapter 13 is a repayment plan. A typical repayment plan will last three to five years. Once you file for bankruptcy relief under Chapter 13, you will be able to stop bill collectors and creditor harassment. You can also prevent utility shutoffs, stop repossession and foreclosures. To find the best solution to your debt problems, call Credit Solutions for a free consultation. Our Milwaukee Chapter 13 bankruptcy lawyers can help you determine whether Chapter 13 is right for you.
Chapter 13 differs from Chapter 7 . In Chapter 13, your debts are categorized differently. You pay back the creditor in one of the following ways:
- all of what you owe them with interest
- all of what you owe them without interest, or
- a portion of what you owe them
A bankruptcy court makes this decision. The court will consider many factors, including the type of debt.
Chapter 13 is typically used by:
- Those who are behind on mortgages or car payments and want to keep those assets
- People who do not qualify under Chapter 7 because they already filed under Chapter 7 within the past 8 years, or
- People who make more money or have more assets and want to keep them.
Chapter 13 can be more advantageous than Chapter 7 (or liquidating) bankruptcy. There are certain debts that you can’t discharge under Chapter 7. In Chapter 13, you can get rid a lot more debt, including child support arrears. You do this by paying back all or part of it to the creditor over the life of the plan (typically 3-5 years).
We are a debt relief agency. We help people file for bankruptcy relief under the Bankruptcy Code.
